Maryland’s Family and Medical Leave Insurance Program Timeline Update

In 2022, the Maryland General Assembly passed the Time to Care Act which established the Maryland Family and Medical Leave Insurance (FAMLI) program for workers in the state. In October 2025, the Department of Labor and Employment published proposed regulations to detail how the program works. The final regulations were published in March 2026.  The employer contribution period is set to begin on January 1, 2027. Employers will be required to remit contributions and wage and hour reports every quarter through paidleave.maryland.gov/ starting in April 2027. Contributions are due on the last day of the month following each quarter. The first contribution payment will cover wages paid January 1-March 31, 2027 and will be due April 31, 2027. Beginning on January 3, 2028, employees will be able to submit a request for paid leave which will be funded by the pool, if the request is accepted.

Beginning on September 1, 2026, third-party agents will be able to manage FAMLI tasks for employers. In fall of 2026, all employers will be required to register their business at paidleave.maryland.gov/. The authorized officer will be an appointed person within the company who is legally permitted to act in an official capacity on behalf of the company. Only the authorized officer is able to register the business with FAMLI, sign a Power of Attorney to grant a third-party authority to act on the company’s behalf, submit a declaration of intent for a private plan, and apply for a private plan.
