Same-Sex Law/LGBT Law

There have been major victories for same-sex couples and everyone on the side of fairness for all. Maryland’s Civil Marriage Protection Act went into effect on January 1, 2013, DOMA was overturned on June 26, 2013, Maryland’s Fertility Parity Bill became effective July 1, 2015,  Maryland’s new privacy law allowing transgender individuals to obtain a birth certificate that does not indicate it was modified, will be effective on October 1, 2015, and most recently, the Supreme Court affirmed that the right to marry is a fundamental right afforded to everyone and therefore, no state may refuse to recognize a same-sex marriage validly performed in another state.  All are major steps forward in the fight for civil rights for the LGBT community.  Even so, same-sex couples, whether married or not, still face some unique legal challenges.  PK Law’s LGBT Practice Group are familiar with all aspects of planning for same sex couples.
